ELIGIBILITY: BOOK IT! Program “Pair of Chairs” Sweepstakes ("Sweepstakes") is open to all K-6 teachers participating in the 2012-2013 BOOK IT! Program within the 50 United States and D.C. (each an “Entrant”). Employees of Pizza Hut, Inc. (“PHI” or “Sponsor”), PHI’s parent, subsidiaries, affiliated companies, franchisees and agents and the immediate family (defined as parents, spouse, children, siblings, grandparents) of each such employees, and all those whom such employees are domiciled, whether related or not, are ineligible to enter or win.
ENTRY PERIOD: Sweepstakes begins on August 15, 2012 and is open through October 29, 2012 (“Entry Period”).
HOW TO ENTER: During the Entry Period, register your Book IT! certificates at www.bookitprogram.com and follow all instructions to complete the official registration form (“Online Entry”). In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the e-mail account. Use of automated devices not valid for entry. Entries become the exclusive property of the Sponsor and will not be returned.
PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”): Twelve (12) prizes consisting of a pair of kid-sized BOOK IT! reaching chairs for classroom use (ARV: $260 per pair; total value of all prizes $3,120) (“Prize(s)”). Limit one (1) prize per Entrant. Odds of winning will depend on the total number of eligible Entries received. Sponsor reserves the right to substitute prizes of equal or greater value in the event that the original prize is not available. No other substitution or transfer of Prizes permitted. Sponsor responsible only for delivery of Prizes; not responsible for Prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of Prize Winners.
PRIZE DEPICTIONS: The depiction of Prizes in any advertising, promotional and online materials may not reflect the actual Prizes delivered to Winners.
RANDOM DRAWING AND PRIZE NOTIFICATIONS: Twelve (12) winners (“Winner(s)”) will be selected in a random drawing on or about October 30, 2012from among all eligible entries received by Sponsor whose decisions are final and binding on all matters relating to the Sweepstakes. Winners will be notified by telephone, e-mail and/or certified mail on or about October 30, 2012. Distribution of Prizes will take place on or about November 12, 2012.
VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Any Winner whose Prize is returned as undeliverable will be disqualified and his/her Prize will be awarded to an alternate winner selected in a random drawing. Prizes that remain unclaimed as of January 31, 2013 will not be awarded.
ADDITIONAL TERMS: By entering, an Entrant agrees (and agrees to confirm in writing if requested): (a) the Official Rules and the decisions of Sponsor, shall be final and binding in all respects; and (b) to release, discharge, indemnify and hold harmless PHI, its parent, subsidiaries, affiliates, franchisees, advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents (and all said entities and individuals are herein, collectively, referred to as the "Releasees") from any and all liabilities, claims and/or damages arising out of his/her/their participation in the Sweepstakes and/or the acceptance, possession, use or misuse of a Prize. Releasees are not responsible for late, lost, mutilated, illegible, incomplete, misdirected, garbled, undelivered or otherwise ineligible registrations, e-mail, postcards, messages and/or other transmissions related to this Sweepstakes. Releasees shall not be responsible for typographical, human and/or other errors, or for any electronic, network, computer or other technical malfunctions. Sponsor may disqualify any Entrant if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor representatives. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and to select winners from among all eligible, non-suspect entries received up to the time of such action. In the event that the Sweepstakes has to be cancelled for any reason, Prizes will be awarded in a random drawing from among all non-winning Sweepstakes entries. Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent of the law. Winners agree to the use of his/her name, address, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its Releasees, without compensation, notification (unless prohibited by law) or additional consents from any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.
LIMITATIONS OF LIABILITY: Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Sweepstakes; any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access of the website; any injury or damage to participants or to any other person's computer(s) related to or resulting from participating in this Sweepstakes, or downloading materials from or use of the website. Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Sweepstakes, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes. The use of any automated launching or entry software or any other mechanical or electronic means that permit a participant automatically to repeatedly enter is prohibited. IN NO EVENT WILL THE RELEASEES BE RESPONSIBLE OR LIABLE FOR AND ENTRANT HEREBY WAIVES ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ACCESS TO AND USE OF THE WEBSITE OR THE DOWNLOADING FROM AND/OR PRINTED MATERIAL DOWNLOADED FROM SAID SITE WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE AND ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE AFOREMENTIONED LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR CONDITIONS REGARDING THESE LIMITATIONS AND/OR EXCLUSIONS.
GOVERNING LAW: By entering, each Entrant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Texas. By entering, each Entrant consents to the jurisdiction and venue of the federal, state and local courts located in the State of Texas. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of Texas.
